Lindsey holds the federal trademark for “The Links” for use in the category of residential real estate. The defendant, Hayden, owns a multi-unit development (apartment builting) in Mississippi called “The Links at Northcreek.” Pretty simple. Having been the VP of a company that provided private label intranets to large apartment complexes, I can tell you for a fact that “The Links at . . . ” are all over the place, and I doubt that they are all owned by Lindsey. The Links at Georgetown in Savannah, Ga., The Links at Citiside, in NC, The Links at Plum Creek in Colorado. What brought this on, of course, is Lindsey’s new complex coming on line soon in Mississippi, The Links at Starkville. Lindsey may find themselves losing a trademark or boxing themselves in to a particular territory if they are not careful.
