Sadly, this isn’t entirely shocking. The law needs to catch its breath, but activists and lobbyists keep pushing it on into darker territory. Hopefully this will change soon.
I think we need to have a 5-8 year moratorium on legislation to let the courts and marketplace shake things out a bit.
I can agree with that, so long as we can first do some repair work to the DMCA, namely stronger penalties for those who abuse DMCA notices and broader exceptions for anti-circumvention.
Once that’s done, I agree a multi-year moratorium on legislation wouldn’t be a bad idea.
But how do we gag the SCOTUS too?
