Copyright Infringement and Standardized Tests

Corey Doctorow, who has just taken the GRE, wrote over at Boing Boing

I was particularly upset by the following statement.

If I reproduce test questions in any manner I am subject to a copyright infringement lawsuit and any other action(s) ETS may take.

I can understand ETS saying that telling someone what’s on the GRE is dishonorable behavior . . . But ‘copyright infringement lawsuit’? That’s crazy talk!

I want to point out that the activities this is meant to prevent are, generally, test prep companies copying exam questions verbatim. An example is this $12 mil. judgement against PMBR for copying questions from the multistate bar exam. There have been plenty of others as well. Paying people to take tests multiple times and then go to the car and record the questions is a large business in the U.S. It is also illegal.
