C.B.C. Distribution and Marketing, Inc. v. Major League Baseball Advanced Media, LP., Ruling

LinkStatistics not intellectual property of MLB. U.S. District Court Judge Mary Ann Medler in St. Louis ruled that CBC Distribution (and all other fantasy leagues) has the right to use game statistics and likenesses of players. The court found that the First Amendment takes precedence over Major League Baseball’s “right of publicity,” stating that the stats are readily available in newspapers and online and so are not the exclusive property of MLB. Thus, no licence is needed to use player’s names and statistics.
